Why Is General Data Protection Regulation (GDPR) In India from 25 May 2018?

The European Union’s (EU’s) General Data Protection Regulation (GDPR) took effect from 25 May in India.

Violating the rules can attract a maximum fine equivalent to 4% of an organization’s global annual revenue or €20 million, whichever is higher.

Under this rule, if the data of company is deleted or missing, companies must also tell all affected users about any data breach, and tell the overseeing authority within 72 hours.

GDPR protects ‘personal data’ of EU data subjects such as name, email, address, IP address, location data, genetic and biometric data, online identifiers, etc.

This data could be of employees, customers, vendors or business partners of an organisation. Stricter protection is granted to sensitive category data, such as political opinions, religious beliefs, trade union membership, racial or ethnic origin, etc.
